Investment Procedure Process
Based on official dispatch 2016/UBND-KTTH dated November 17, 2017 of An Giang People's Committee on the implementation of investment procedures in An Giang province.

Step 1: Contact, introducing investment location and registration for investment project implementation:

1. Investor looking for investment opportunities in An Giang that can contact all departments in An Giang province to introduce investment locations and projects.

Department of Planning and Investment and An Giang Economic Zone Authority will guide procedure and evaluate investment policy, grant the investment registration certificate strictly according to provisions of law on investment, land and construction

2. Registration for investment project implementation

Agencies receiving and processing dossiers: Department of Planning and Investment and Economic Zone Authority

Step 2: Decision on investment policy:

Project under Government's investment decision competence, include following projects:

Project under investment decision authority of the provincial People's Committee, include following projects:

+ Project assigned or leased land by the State without auction, bidding or transfer; project has requested to change land use purpose.

+ Project using technology on catalogue of restricted technology transfer in accordance with the law on technology transfer.

Processing time: Within 16 days after receiving valid dossiers, the provincial People's Committees will consider and decide on investment policy.

* In case of project with foreign direct investment capital (FDI) at commune, ward or town that belong to border zone. Before approval of investment policy, investment registration agency will gather comments from concerned agencies in accordance with the Law on land (Ministry of Defense, Ministry of Public Security, Ministry of Foreign Affairs ...)

* In case of adjustment of investment policy: processing time is 12 days (compared to current regulation is 25 working days)

Step 3. Issuance of investment registration certificate and establishment of business:

- Investor can carry out these 02 procedures in 01 working day at the Department of Planning and Investment.

- In case of project subject to decision on investment policy:

+ Granting investment registration certificate to investor within 01 working day after receiving decision on investment policy (compared to current regulation is 25 working days).

+ Granting business registration certificate to investor within 08 working hours from date of Granting investment registration certificate (compared to current regulation is 3 working days)

- In case project is not subject to decision on investment policy, The Department of Planning and Investment issues investment registration certificate within 5 working days from date of receipt of the valid documents (compared to current regulation is 15 working days)

* Note: enterprise establishment applies only to foreign individuals and organizations investing in Vietnam for first time and for Vietnamese individuals investing in An Giang province.

Step 4: Procedures for implementing the project

Investor can carry out parallel or each type of procedure to implement project:

1. charting detailed plan of 1/500 scale:

- Case 1: Investment project construct in urban area that comply with general planning or construction zoning plan have been approved by authority, investor make detailed plan of 1/500 scale and present to the Division of Urban Management (or Division of Economic and Infrastructure) to evaluate and submit to district-level People's Committee for agreement with Department of Construction  approved within 30 days (compared to current regulation is 45 working days)

- Case 2: Investment projects construct in urban area but not in line with general plan or construction zoning plan have been approved by authority, investor make detailed plan of 1/500 scale and present to Department of Construction (Based on written agreement of district-level People's Committee) verify and submit to Provincial People's Committee for approval within 40 days (compared to current regulation is 45 working days)

- Case 3: Investment projects construct outside urban area (rural area) in district, investor make detailed plan of 1/500 scale and present to Division of Economics and Infrastructure (Division of Economic and Infrastructure will base on land use planning and new rural construction planning (criteria 1.1 and 1.2) approved and in line with locality’s socio-economic development orientation) to evaluate and submit to district-level People's Committee for approval within 30 days (compared to current regulation is 45 working days)

* Note: For investment projects implemented by one investor with project size is smaller than 05 hectares (less than 02 hectares for condominium projects), investor can draw a total plot of 1/500 scale (no detailed plan of 1/500 scale is required)

2. Construction permit procedure:

- New Procedure issued by Department of Construction: 15 working days (compared to current regulation is 20 working days)

- New Procedure issued by district-level People's Committee: 10 working days (compared to current regulation is 10 working days)

- Renew, adjust, re-issue: 05 working days (compared to current regulation is 05 working days)

3. Environmental procedure:

- Approval of environmental impact assessment report: 30 working days (compared to current regulation is 50 working days)

- Approval of environmental protection plan: 10 working days (confirmed by Department of Natural Resources and Environment or district-level People's Committee)

4. Land procedure:

- No via auction: 23 working days (compared to current regulation is 46 working days)

- Changing purpose of land use: 23 working days (compared to current regulation is 43 working days)

5. Other related procedures:

- Fire-prevention procedure: 15 working days (compared to current regulation is 20 working days)

- Power supply procedure (middle voltage): 30 working days (compared to current regulation is 35 working days)

- Water supply procedure: 07 working days

- Sewerage procedure: 10 working days

Step 5: Implementing the project

Step 6: Completion of acceptance test and operation; registering assets ownership attached to land.
